DISINFO: The International Criminal Court ruled Israel has no right to self-defence

SUMMARY

As an occupying power, Israel has no legal basis to claim the right to self-defence in the current conflict. This was affirmed by a 2004 advisory opinion issued by the International Criminal Court.

RESPONSE

The claim advances an emerging disinformation narrative regarding the Hamas attack on Israel which took place on October 7th 2023.

The International Criminal Court ruling discussed in the claim said nothing of the sort. The 2004 advisory opinion concerned the construction by Israel of a dividing wall on Palestinian territory, which the Court deemed in violation of international law. The Court further stated that Israel had no right to claim that the project constituted an exercise in self-defence, but did not deny Israel the right to self-defence, which is a fundamental and inherent privilege of every state under attack, as recognised by customary international law, legal precedent, and countless treaties.
